3. No Guarantee of Results
We work to provide professional services designed to improve your online presence, lead capture, follow-up, automation, and business systems. However, we do not guarantee specific financial results, sales results, rankings, leads, conversions, revenue, customer growth, or advertising performance.
Business results depend on many factors outside of our control, including your offer, pricing, market demand, competition, sales process, response time, reputation, budget, customer service, and business operations.
Any examples, testimonials, case studies, or statements about results are for informational purposes only and do not guarantee that you will achieve the same or similar results.
4. Client Responsibilities
If you hire us for services, you agree to provide accurate information, timely feedback, required access, content, approvals, images, branding assets, business details, and any other materials reasonably needed to complete the work.
You are responsible for ensuring that any content, images, videos, logos, trademarks, customer lists, reviews, claims, offers, and business information you provide are accurate, lawful, and that you have the right to use them.
Delays in providing information, access, content, feedback, or approvals may delay the project timeline.
5. Payments
Payment terms will be stated in the applicable invoice, proposal, service agreement, or checkout page.
Unless otherwise agreed in writing, payments are due according to the payment schedule provided. Failure to pay may result in paused work, suspension of services, delayed delivery, removal of access, or termination of services.
Subscription services, software access, hosting, CRM access, automation systems, phone numbers, messaging services, advertising management, or ongoing support may be billed on a recurring basis.
By purchasing a recurring service, you authorize us or our payment processor to charge your payment method according to the billing terms agreed upon.
6. Refunds and Cancellations
Refunds are not guaranteed unless specifically stated in a written agreement or offer.
Because many services involve time, labor, strategy, setup, design work, software configuration, and custom implementation, payments for completed work, setup fees, deposits, and strategy work are generally non-refundable.
Recurring services may be canceled according to the terms stated in your agreement, invoice, or written cancellation policy. Canceling a service may result in loss of access to software, systems, automations, phone numbers, websites, funnels, forms, calendars, or other assets managed through our platform.
Clients may cancel recurring services by providing written notice by email to [email protected].
Unless otherwise stated in a signed agreement, cancellation requests must be submitted at least 30 days before the next billing date. If cancellation notice is received after that period, the next scheduled payment may still be due.
Canceling recurring services may result in the suspension or loss of access to services, software, CRM systems, automations, phone numbers, messaging services, websites, funnels, forms, calendars, hosting, support, and other systems managed through Major Design and Solutions / Major Systems LLC.
Cancellation does not remove the client’s responsibility to pay any outstanding balances, past-due invoices, setup fees, completed work, software charges, usage charges, messaging fees, phone charges, advertising costs, or other charges already incurred.
If a client wants to transfer websites, domains, accounts, automations, CRM data, or other assets after cancellation, transfer assistance may be billed separately unless otherwise stated in a written agreement.
Major Systems LLC, doing business as Major Design and Solutions, reserves the right to suspend or terminate services for non-payment, misuse of systems, violation of these Terms, unlawful activity, platform policy violations, or actions that create risk for our business, platforms, vendors, or other clients.
7. Website and Software Access
Some services may involve third-party platforms, including but not limited to GoHighLevel, LeadConnector, Google, Meta, Shopify, Stripe, domain providers, hosting providers, email providers, calendar tools, payment processors, or other software systems.
We are not responsible for outages, bugs, pricing changes, policy changes, account restrictions, platform decisions, data loss, service interruptions, or technical issues caused by third-party platforms.
You are responsible for maintaining access to your own accounts, payment methods, business information, logins, domains, email accounts, and third-party tools unless otherwise agreed in writing.
8. SMS, Email, and Communication Systems
If we provide or configure SMS, email, chat, or automation systems, you are responsible for using those systems lawfully and in compliance with applicable laws, carrier rules, platform policies, and consent requirements.
This includes, but is not limited to, SMS consent, opt-in language, opt-out language, privacy policies, terms, message frequency, prohibited content, and proper handling of customer data.
Users may opt out of SMS communications by replying STOP. Users may request help by replying HELP. Message and data rates may apply. Message frequency may vary. Consent to receive marketing messages is not a condition of purchase.
We are not responsible for your misuse of SMS, email, CRM, marketing, automation, or customer communication systems.
9. Intellectual Property
Unless otherwise agreed in writing, we retain ownership of our internal processes, templates, frameworks, strategies, workflows, automation structures, designs, source files, copywriting concepts, and business methods.
Upon full payment, you may receive a license or ownership rights to certain completed deliverables specifically created for you, such as website pages, public-facing written content, or graphics, subject to any third-party platform limitations.
You may not copy, resell, redistribute, reverse engineer, or claim ownership of our proprietary systems, templates, processes, automations, strategies, or materials without written permission.
10. User Content
You may provide content, materials, images, logos, videos, customer data, product information, business information, or other materials for us to use in connection with your project.
You represent that you own or have permission to use any content you provide. You agree not to provide content that is unlawful, misleading, infringing, defamatory, harmful, or violates the rights of others.
We may refuse to use or publish content that we believe is inappropriate, unlawful, misleading, or harmful.
